General Terms and Conditions for Online Booking of Vouchers at Paracelsus-Therme Bad Liebenzell
1. Scope of application
These terms and conditions apply to the sale of vouchers or other services, insofar as these are available for purchase or booking via the entervo-access GmbH online shop at https://www.gurado.de/paracelsus-therme-gutscheine/geschenkgutscheine.html.
2. Contractual partner of the customer
The contractual partner within the scope of the following general terms and conditions is Freizeit und Tourismus Bad Liebenzell GmbH, Kurhausdamm 2-4, 75378 Bad Liebenzell.

The sale of admission tickets and ancillary services is carried out in the name and on behalf of Freizeit und Tourismus Bad Liebenzell GmbH.
3. Purchase of vouchers
You can purchase gift certificates online via the Internet shop in various denominations offered there.
4. Conclusion of contract for vouchers
1. The vouchers offered on our website do not constitute an offer to conclude a contract, but merely an invitation to place an order.
2. By placing your order, you are submitting an offer to conclude a purchase contract. The contract is concluded when the ordered voucher is sent to you. Confirmation of receipt of your order does not constitute acceptance of your offer. It is merely intended to inform you that your order has been received.
5. Prices, terms of payment, retention of title
1. Unless otherwise agreed, the admission prices valid on the day of redemption of the vouchers in our pools apply to the redemption of vouchers.
2. As the purchaser, you are only entitled to set-off rights if your counterclaims have been legally established, are undisputed, or have been recognized by us in writing. Furthermore, you are only authorized to exercise a right of retention insofar as your counterclaim is based on the same contractual relationship.
3. The voucher remains our property until full payment has been made. If you are more than 10 days late with payment, we have the right to withdraw from the contract and block the voucher.
6. Redeeming vouchers and day passes
1. The vouchers can be used to pay for all admission fees payable at the pool ticket offices and, if applicable, also for the purchase of swimming accessories, additional payments, or other pool services that are payable at the pool ticket offices.
2. Payment for goods purchased in the online store and services booked in the online store is also possible in addition to sentence 1.
3. Cash payment of unredeemed credit balances is not possible. No replacement will be provided in the event of loss.
4. Vouchers are transferable and not linked to a specific person. However, resale is prohibited. They can be redeemed in several installments and during several visits. If the value of a voucher is not sufficient to pay for goods or services, you can pay the difference using another payment method approved by Paracelsus-Therme Bad Liebenzell or by redeeming additional vouchers.
5. A day ticket purchased by the user entitles the user exclusively to visit the Paracelsus-Therme on the selected date. If the user does not use the ticket and thus the service on this date, their entitlement to the service expires. In this case, a refund of the purchase price by Paracelsus-Therme or Freizeit und Tourismus Bad Liebenzell GmbH is excluded.
7. Validity period of vouchers
Gift certificates are valid for three years from the date of issue (until the end of the calendar year). After this period, gift certificates can no longer be redeemed. Any remaining credit will not be paid out.
11. Withdrawal
Beyond the statutory rights of withdrawal, there are no further contractual rights of withdrawal. The statutory warranty rights apply.
14. Payment
1. Payment is made online via PayPal.
2. If the customer defaults on their payment obligation, Paracelsus-Therme Bad Liebenzell has the right to withdraw from the contract after issuing a reminder and setting a reasonable grace period. Services already received must be returned by the customer without delay.
3. In the event of a return debit note caused by the customer, the customer is obliged to reimburse Paracelsus-Therme Bad Liebenzell for any bank charges incurred as a result of the return debit note. The customer is given the opportunity to prove that the return debit note resulted in lower or no charges.
15. Liability
1. Participation and use of the Paracelsus Therme is at your own risk.
2. The liability of Freizeit und Tourismus Bad Liebenzell GmbH and its legal representatives or vicarious agents is limited to damage caused intentionally or through gross negligence. This limitation of liability does not apply to damage resulting from injury to life, limb, or health.
16. House and bathing rules
By booking a voucher and using the Paracelsus-Therme, the customer accepts the house and bathing rules applicable to the use of the baths. These are clearly displayed in the entrance area of the Paracelsus-Therme Bad Liebenzell.
17. Data storage / Data protection
Paracelsus-Therme Bad Liebenzell stores and processes the customer's data collected in the context of concluding the contract in compliance with the provisions of the Federal Data Protection Act. All personal data collected from the customer will be treated confidentially. The necessary data will only be used in connection with order processing (payment, shipping) and will not be disclosed to third parties. The customer can obtain information about the stored data at any time free of charge by sending an email to Paracelsus-Therme Bad Liebenzell (info@bad-liebenzell.de).
18. Cancellation policy
The following cancellation policy applies only if the customer is a consumer within the meaning of §13 BGB (German Civil Code), i.e. if he concludes the contract for purposes that are predominantly neither commercial nor self-employed.
Cancellation policy / Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract. To exercise your right of withdrawal, you must inform us (Freizeit und Tourismus Bad Liebenzell) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax, or email).
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.
Consequences of revocation
If you revoke the contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.
If you have requested that the service should commence during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you inform us of your exercise of the right of withdrawal with regard to this contract, compared to the total scope of the services provided for in the contract.
19. Written form and severability clause
1. Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions and the contract as a whole.
2. The place of performance for all obligations arising from this contractual relationship is Überlingen.
3. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
4. The place of jurisdiction is Münster, provided that the customer is considered to be an entrepreneur.
20. Written form and severability clause
The vouchers have a value corresponding to the purchase price and can be used for the entire product range of the Paracelsus-Therme. The list is only an example. When redeeming the above option, the prices valid on the day of redemption apply. If there is a price change for a service, this will result in a corresponding refund (in the case of a price reduction) or an additional payment (in the case of a price increase).
