A1 House and bathing regulations
§1 Purpose of the house and bathing regulations
- These house and pool rules are designed to ensure safety, order, and cleanliness throughout the Paracelsus-Therme and Sauna Pinea facilities .
§2 Binding nature of the house and bathing rules
- The house and bathing regulations and all other regulations are binding for users. The statutory regulations apply to the inclusion in the contract concluded at the cash desk.
- The staff or other representatives of the pool exercise domiciliary rights. Instructions given by staff or other representatives must be followed. Users who violate the house and bathing rules may be expelled from the premises. In such cases, the admission fee paid will not be refunded. The user of the pool expressly reserves the right to prove that in this case the pool operator is entitled to no compensation or a significantly lower compensation than the full admission fee. In addition, a ban from the premises may be issued by the management/operating company or its representatives.
- The marked and designated areas of the company are under video surveillance for security reasons. The provisions of the Federal Data Protection Act, in particular § 4, are complied with. Stored data is deleted immediately if it is no longer required or if the interests of the data subjects worthy of protection prevent further storage.
- The house and pool rules apply to general pool operations. Exceptions may be permitted for special events or use by certain groups of people (e.g. school and club swimming) without the need to repeal the house and pool rules.
- Political activities, events, demonstrations, the distribution of printed matter, the display of posters or notices, the collection of signature lists and the use of the baths for commercial or other purposes not customary in the baths are only permitted with the approval of the operator.
§3 Opening hours, prices
- The opening hours and the valid price list are announced on the notice board or can be viewed at the cash desk.
- The bathing and sauna area must be vacated 15 minutes before the end of opening hours.
- Special admission requirements and opening hours may be stipulated for school and club swimming as well as for courses and events for certain groups of people.
- If the use of individual offers or individual parts of the pool is restricted or if the pool is closed during operation, there is no entitlement to a reduction or refund.
- Purchased access rights are non-refundable.
- Please keep the admission pass you received at the ticket counter until you leave the pool.
§4 Access
- In principle, every person is free to visit the company; restrictions may be imposed in certain cases.
- Each user must have valid access authorization for the respective area. Once the area has been entered, the access authorization may not be transferred to others.
- The user must store their access card, valuables, and rental items in such a way as to prevent loss. In particular, they must carry these items on their person, keep them with them when moving about the facility, and not leave them unattended. Failure to comply with these requirements constitutes negligent conduct on the part of the user in the event of loss. In the event of a dispute, the burden of proof regarding compliance with the aforementioned proper safekeeping rests with the user.
- Children aged 6 to 16 must be accompanied by a suitable adult. Additional regulations and age restrictions (e.g., for sauna facilities and wellness areas) may apply. Accompanying adults must supervise the children at all times during their stay. Children under the age of 5 may only use the thermal baths for exercise therapy if prescribed by a doctor.
- Persons who are unable to move about safely without assistance are permitted to use the thermal baths or sauna only when accompanied by a suitable escort.
- Admission is not permitted to the following persons, among others:
- who are under the influence of intoxicating substances,
- the animals carry with them,
- who suffer from a notifiable communicable disease (in case of doubt, a medical certificate may be required) or open wounds.
§5 Rules of conduct
- Users must refrain from doing anything that is contrary to good morals and the maintenance of safety, peace and order.
- The facilities at Paracelsus-Therme, including rental items, must be treated with care. In the event of improper use or damage, the user is liable for any resulting damage. For intentional soiling that exceeds the extent of normal use, a special cleaning fee may be charged, the amount of which will be determined on a case-by-case basis according to the effort required.
- Different dress codes apply in certain areas of the spa.
- Barefoot areas may not be entered with street shoes. Any aids brought along, such as wheelchairs or walking frames as well as wheeled suitcases, must be cleaned by the user or their companion before entering the barefoot area.
- Users are not permitted to use musical instruments, sound or image reproduction devices and other media if this causes a nuisance to other users.
- Photographing and filming other people and groups without their consent is not permitted. For commercial purposes and for the press, photography and filming requires the prior permission of the management.
- You must wash thoroughly before using the pools. Shaving, cutting nails, dyeing hair, and similar activities are not permitted.
All users must exercise extra caution to account for the typical hazards found in a swimming facility, such as wet and/or soapy floors. Non-slip swim shoes are required.
- The use of sports and play equipment is not permitted. Swimming aids are only permitted with the consent of the supervisory staff.
- Food and drinks may only be brought in for personal consumption and may only be consumed in the designated areas. Bringing alcoholic beverages is prohibited. In the catering area, food and drinks brought in may only be consumed at the "self-catering tables".
- Fragile containers (e.g. containers made of glass or porcelain) may not be brought in.
- Smoking is only permitted in the designated areas. This also applies to electronic cigarettes and shishas.
- Lost property must be handed over to the staff and will be handled in accordance with the statutory provisions.
- Checkroom lockers and/or safe deposit boxes are only available for use during the validity of the user's access authorization. There is no entitlement to use. After closing time, all lockers and valuables compartments that are still locked will be opened and cleared if necessary. The contents will be treated as lost property.
- Loungers and chairs may not be permanently covered with towels, bags or other objects. Objects placed on the loungers and chairs will be removed by the staff if necessary. All seating, lounger and rest areas may only be used with a dry bath towel and/or bathrobe.
§6 Liability
- The operator is generally not liable for damages suffered by users. This does not apply to liability for breach of a material contractual obligation and for liability for damages to the user arising from injury to life, limb or health, nor for damages suffered by the user due to an intentional or grossly negligent breach of duty by the operator, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on whose compliance the user may regularly rely.
- The essential contractual obligation of the operator includes in particular, but not exclusively, the use of the bathing facilities, unless they are partially closed for compelling operational reasons, as well as participation in the events offered and included in the admission price. The limitation of liability according to paragraph 1 sentences 1 and 2 also applies to the vehicles parked in the parking spaces of the baths.
- The user is expressly advised not to take any valuables into the pool. The operator does not assume any security or duty of care for any valuables brought into the pool. The operator is only liable for the loss of valuables, cash and clothing in accordance with the statutory regulations. This also applies to damage to items by third parties.
- The depositing of money or valuables in a checkroom locker and/or a safe deposit box provided by the operator does not create any obligations on the part of the operator with regard to the deposited items. In particular, no safekeeping obligations are established. It is the sole responsibility of the user, when using a checkroom locker and/or a safe deposit box, to lock them properly, to check that the respective device is securely locked and to store the keys/data carriers carefully.
- In the event of culpable loss of the items provided by the pool operator in accordance with § 4 (3), the following lump sums will be charged:
- Admission fee: €10.00
- Bathrobe 40,00 €
- Towel €30.00
- Swimwear €30.00
The user is expressly permitted to prove that no damage has occurred at all or that it is significantly lower than the lump sum. If the aforementioned items are found and the user has left his contact details with the pool operator, the pool operator will contact him and offer to refund the lump sum paid.
Regarding the loss of the access card: The receipt provided upon purchase of the access card must be retained until you leave the facility. In the event of the loss of the access card, this receipt makes it possible to determine the amount that was loaded onto the card (e.g., purchases of food and beverages). The user must pay this amount plus the aforementioned €10.00 for the loss of the access card. If the amount charged cannot be determined due to the loss of both the access card and the receipt, the user must pay €50.00.
